WildFlings Terms of Service and User Agreement

1. Acceptance of Terms

By creating an account, logging in, browsing, or otherwise using the WildFlings Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy, which is incorporated herein by reference. These Terms constitute a legally binding contract between you ("User") and WildFlings.

If you are using the Platform on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms. The Platform is intended for adults who are at least 18 years of age or the age of majority in their jurisdiction. By using the Platform, you represent that you meet these age requirements.

2. Description of Services

WildFlings provides an online platform that facilitates social connections, networking, and dating among consenting adults. Our services include profile creation, matchmaking algorithms, communication tools, and event discovery features.

1. Platform Nature: WildFlings is a facilitator, not a participant, in any interactions between users. We do not guarantee matches, connections, or specific outcomes.
2. Service Modifications: We reserve the right to modify, suspend, or discontinue any aspect of the Platform at any time, with or without notice.
3. Geographic Availability: Services may not be available in all regions. It is your responsibility to ensure your use of the Platform complies with local laws.

3. User Responsibilities & Conduct

You are solely responsible for your conduct, your profile content, and your interactions with other users on the Platform. You agree to use the Platform lawfully and ethically.

Prohibited Activities Include, but are not limited to:

1. Harassing, threatening, or bullying any other user.
2. Posting false, misleading, or fraudulent information.
3. Impersonating any person or entity or misrepresenting your affiliation.
4. Uploading or transmitting viruses, malware, or any destructive code.
5. Engaging in any activity that interferes with or disrupts the Platform's infrastructure.
6. Using the Platform for any illegal purpose, including solicitation or exploitation.
7. Scraping, data mining, or using automated systems to extract data from the Platform.
8. Violating any applicable local, state, national, or international law or regulation.

We reserve the right to investigate and take appropriate legal action against anyone who violates these provisions, including removing offending content, suspending or terminating accounts, and reporting to law enforcement.

4. Intellectual Property Rights

The WildFlings Platform, including its design, features, graphics, logos, text, software, and all content provided by WildFlings (the "WildFlings Content") is owned by or licensed to us and is protected by copyright, trademark, and other intellectual property laws.

1. Your License: We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal, non-commercial purposes in accordance with these Terms.
2. Your Content: You retain ownership of any content you submit, post, or display ("User Content"). By posting User Content, you grant WildFlings a worldwide, royalty-free, sublicensable license to use, host, store, reproduce, modify, and display such content to operate and improve the Platform.
3. Restrictions: You may not copy, modify, distribute, sell, or lease any part of the WildFlings Content or Platform without our express written permission. The "WildFlings" name and logo are trademarks and may not be used without permission.

5. Limitation of Liability

To the fullest extent permitted by applicable law, WildFlings, its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

1. Your access to or use of or inability to access or use the Platform.
2. Any conduct or content of any third party on the Platform, including without limitation, any defamatory, offensive, or illegal conduct of other users.
3. Any content obtained from the Platform.
4. Unauthorized access, use, or alteration of your transmissions or content.

In no event shall WildFlings's aggregate liability for all claims relating to the Platform exceed the greater of one hundred U.S. dollars (US $100) or the amount you paid WildFlings, if any, in the past twelve months for services giving rise to the claim.

6. Disclaimer of Warranties

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WILDFLINGS EXPLICITLY DISCLAIMS ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WildFlings does not warrant that: (a) the Platform will function uninterrupted, secure, or available at any particular time or location; (b) any errors or defects will be corrected; (c) the Platform is free of viruses or other harmful components; or (d) the results of using the Platform will meet your requirements. Your use of the Platform is solely at your own risk.

7. Termination

You may stop using the Platform at any time. We may suspend or terminate your access to the Platform, delete your profile and any content or information you have posted, and/or prohibit you from using or accessing the Platform for any reason, at our sole discretion, with or without notice.

Upon termination, all licenses and other rights granted to you in these Terms will immediately cease. Provisions of these Terms that, by their nature, should survive termination (including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability) shall survive.

8. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.

Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be finally settled by arbitration in accordance with the rules of a recognized arbitration body. The seat of arbitration shall be London, United Kingdom. The language of the arbitration shall be English.

9. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect, typically by posting a notice on the Platform or sending an email to the address associated with your account.

What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Platform after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the Platform.
